Successful prosecution for build-up of household rubbish

A man and woman have been ordered to pay a total of £1441.30 for failing to clear a build-up of household rubbish.

Miss Patricia Manning and Mr Gavin Wilson of Parkinson Street, Blackburn were served a notice under section 46 of the Environmental Protection Act 1990, which required the removal and disposal of the waste which was found close to the rear of their property, in a legal manner. This was not complied with.

The case was heard at Blackburn Magistrates, and the Defendants failed to attend at Court, with the matter proved in their absence. The Defendants were fined £400, with a victim surcharge of £40. The defendants were also required to pay £280.65 costs

Cllr Jim Smith, Executive Member for Environment said, “The vast majority of residents dispose of their rubbish hygienically, and correctly to avoid prosecution and fines, and to help keep their neighbourhoods clean both for themselves, and others.

“Those who do not will be named and shamed in the press, whilst we will also work hard with members of the public through the Your Call campaign to keep our community clean.”
